For Use of Employer-Issued Virtual Debit Card (TransPecos Banks Wallet)
This Authorized User Agreement (“Agreement”) governs the terms under which individuals (“Authorized Users”) may access and use a virtual debit card linked to a Wallet account owned by your employer, issued by TransPecos Banks, SSB, Member FDIC, and administered through Catch.
By activating or using the virtual debit card, the Authorized User agrees to the terms of this Agreement. If the Authorized User does not agree, they should not activate or use the card.
1. Nature of Access and Ownership
1.1 The Wallet and all associated funds are owned solely by the Employer. The Authorized User has no ownership interest and may only access the Wallet for permitted purposes.
1.2 The Authorized User’s role is limited to transacting approved health insurance premium payments under the Employer’s Individual Coverage Health Reimbursement Arrangement (ICHRA) program.
2. Identity Verification and Compliance Obligations
To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
2.1 In accordance with the USA PATRIOT Act and Bank Secrecy Act, identity verification is required prior to card activation. The Authorized User consents to screening procedures and must provide accurate, current, and complete personal information.
2.2 Use of the card is subject to all applicable federal and state laws and may be revoked due to noncompliance.
3. Activation and Implied Consent
3.1 The virtual debit card must be activated following instructions provided via email.
3.2 Activation or use of the card constitutes:
- Consent to this Agreement;
- Acceptance of all terms, conditions, and restrictions;
- Confirmation that the information provided is true and current.
3.3 If the Authorized User does not wish to agree to these terms, they must delete the email containing the virtual card information and refrain from activating or using the card.
4. Permitted Use and Limitations
4.1 The card may only be used to pay eligible health insurance premiums through Catch or authorized insurance carriers.
4.2 Prohibited uses include:
- Cash withdrawals, cash advances, or deposits to ATMs.
- Payments to merchants other than insurance carriers, state or federal marketplaces, or other parties explicitly permitted in writing by the Bank.
- Peer‑to‑peer transfers, person‑to‑person payments, or wallet‑to‑wallet transfers.
- Cryptocurrency or digital‑asset purchases.
- Any transaction that the Bank reasonably believes is for personal, family, or household use unrelated to the ICHRA Program.
Usage of the card for any prohibited purpose may result in the immediate suspension or closure of the card and/or associated wallet.
- 4.3 The card is a commercial instrument and is not subject to consumer protections under the Electronic Fund Transfer Act (Regulation E).
5. Security and Reporting Obligations
5.1 The Authorized User is responsible for protecting the card information and reporting any unauthorized use immediately by contacting help@catch.co.
5.2 The Employer and its service providers may investigate suspicious activity and suspend or terminate access as necessary.
6. Revocation and Termination
6.1 The Employer or Catch may suspend, limit, or revoke card access at any time, with or without notice.
6.2 Access to the card terminates automatically upon:
- The end of employment or authorized relationship with the Employer
- Determination of misuse, fraud, or violation of this Agreement
6.3 The Authorized User agrees to cease using the card and delete all stored card data if access is terminated or revoked.
7. Privacy and Data Handling
7.1 By using the card, the Authorized User agrees to the use and disclosure of their personal information as described in the Catch Privacy Policy available at, https://catch.co/legal/privacy.
7.2 Personal data may be shared with the Employer, TransPecos Banks, and applicable regulators for compliance, operational, or security purposes.
8. Disclaimers and Legal Terms
8.1 Catch is a financial technology company and not a bank. TransPecos Banks, SSB, Member FDIC, is the issuing bank. Funds in the Wallet may be eligible for FDIC pass-through insurance, subject to regulatory conditions.
8.2 Availability of funds may be restricted due to system outages, legal holds, or compliance review.
8.3 The Bank and Catch are not responsible for losses resulting from unauthorized use of the card by the Authorized User.
9. Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law provisions.
10. Acceptance of Terms
By activating or using the virtual debit card, the Authorized User acknowledges and agrees to:
- Be bound by the terms of this Agreement;
- Use the card only for eligible ICHRA health insurance premium payments;
- Comply with all legal and security requirements.
If the Authorized User does not agree to the terms of this Agreement, they must refrain from activating or using the card.
